Booking, Cancellation and Refund Policy

1. About This Policy

This policy applies to bookings and services supplied by:

VIBE Events & Media Ltd provides event planning, show promotion, photography, videography, graphic design, content production, DJ and entertainment services.

As we primarily provide services rather than physical products, items cannot normally be returned or exchanged in the same way as retail goods.

2. Confirming a Booking

A booking is confirmed only when:

  • You have accepted our quotation or proposal in writing;

  • You have provided the information required for the project;

  • You have agreed to our Terms and Conditions; and

  • We have received any required deposit or initial payment.

Until the booking is confirmed, we are not required to reserve an event date, begin work or engage suppliers.

3. Deposits

A deposit may be required to reserve an event date or begin a creative project.

The amount and payment deadline will be stated in your quotation or invoice.

The deposit forms part of the total price.

A deposit is not automatically non-refundable in every circumstance. Where a booking is cancelled, we may retain an amount that reasonably reflects:

  • Work already completed;

  • Planning and administration already undertaken;

  • Time reserved for the booking;

  • Creative work already produced;

  • Non-refundable supplier costs;

  • Advertising expenditure;

  • Travel or equipment commitments; and

  • Other reasonable losses caused by the cancellation.

We will not retain more than is reasonable and legally permitted.

4. Consumer Cancellation Rights

Where you are acting as a consumer and enter into a service contract online, by telephone or away from our business premises, you may have a legal right to cancel within 14 days after the Contract is entered into.

Your message must clearly state:

  • Your name;

  • The service booked;

  • The booking or invoice number, where available;

  • The date the booking was made; and

  • That you wish to cancel.

Where you ask us to begin work during an applicable 14-day cancellation period, you expressly request early performance of the Services.

If you cancel after work has started, you may be required to pay a reasonable and proportionate amount for the Services already supplied.

Your cancellation right may end where the Service has been fully performed during the cancellation period following your express request and acknowledgement.

The statutory cancellation period may not apply to certain leisure, entertainment or event services arranged for a specific date or period of performance.

Nothing in this policy restricts any cancellation right provided to you by law.

5. Cancellation by the Client

Cancellations must be made in writing by email.

Where a statutory cancellation right does not apply, or the applicable cancellation period has ended, any refund will be calculated according to:

  • The amount of work already completed;

  • The notice provided before the event or project date;

  • Whether the reserved date can reasonably be rebooked;

  • Supplier costs already incurred;

  • Non-refundable third-party payments;

  • Advertising or printing expenditure;

  • Custom work already produced; and

  • Other reasonable and foreseeable losses resulting from the cancellation.

A quotation or booking confirmation may include a cancellation schedule specific to the project.

Any cancellation charge will be reasonable and will not exceed the losses arising from the cancellation.

6. Rescheduling

Requests to change an event or project date must be made in writing.

Rescheduling is subject to our availability and cannot be guaranteed.

Where a new date is agreed:

  • Payments already made may be transferred to the new date;

  • Additional planning or supplier costs may be charged;

  • A rescheduling fee may apply where stated in the quotation; and

  • The price may be revised where the venue, scope, date or supplier costs change.

Where we are unavailable for the requested new date, the request may be treated as a cancellation by the Client.

7. Custom Creative Work

Graphic designs, promotional materials, edited photographs, videos, branding, music videos and other creative work are produced specifically for each Client.

Refunds will not normally be provided simply because a Client changes their mind after custom work has begun.

Where a project is cancelled, any refund will take account of:

  • Work already performed;

  • Concepts or drafts already produced;

  • Revisions completed;

  • Licensed materials purchased; and

  • Third-party costs already incurred.

This does not affect your legal rights where Services have not been provided with reasonable care and skill.

8. Changes and Revisions

The number of included revisions will be stated in the quotation or project agreement.

Additional revisions, changes of direction or requests made after final approval may carry an additional charge.

Where you approve artwork, schedules, promotional information or other content, we are not responsible for errors originating from information supplied or approved by you.

9. Cancellation by VIBE Events & Media Ltd

We may cancel or suspend a booking where:

  • An invoice remains unpaid;

  • Required information has not been supplied;

  • Working conditions are unsafe;

  • The Client commits a serious breach of the agreement;

  • The Client or another person behaves abusively or unlawfully;

  • A venue prevents us from providing the Services; or

  • Circumstances outside our reasonable control prevent performance.

Where we cancel for reasons that are not caused by the Client and are not circumstances outside our reasonable control, we will refund payments received for Services that have not been supplied.

Where reasonably possible, we may instead offer:

  • An alternative date;

  • A replacement professional or performer;

  • A revised service; or

  • A partial refund for the part of the Service not supplied.

10. Circumstances Outside Our Control

Where an event or project cannot proceed because of circumstances outside either party’s reasonable control, we will first try to:

  • Reschedule the booking;

  • Provide a reasonable alternative; or

  • Agree another suitable solution.

Any refund will take account of:

  • Work already completed;

  • Services already supplied;

  • Non-refundable third-party costs; and

  • Costs reasonably committed before the cancellation.

11. Problems With a Service

Please contact us as soon as possible where you believe that a Service has not been delivered as agreed.

  • Your name;

  • Your booking or invoice number;

  • A description of the issue;

  • Relevant dates; and

  • Supporting photographs, files or information where applicable.

Where a problem can reasonably be corrected, you must give us a reasonable opportunity to put it right.

Depending on the circumstances and your legal rights, an appropriate remedy may include:

  • Repeat performance;

  • Correction of the work;

  • Replacement of an agreed deliverable;

  • A reasonable price reduction; or

  • A full or partial refund.

12. Refund Processing

Where a refund is due, we will confirm the amount in writing.

Refunds will normally be made using the original payment method unless another method is agreed.

We aim to issue an approved refund within 14 days. Your bank or payment provider may require additional processing time before the payment appears in your account.

13. Physical Products

VIBE Events & Media Ltd does not currently operate primarily as a physical-product retailer.

Where we later sell physical goods, separate product-return terms will be provided at the point of sale.

Nothing in this policy affects your statutory rights regarding faulty, damaged or incorrectly described goods.
